Judge Ervin Files for NC Supreme Court Seat N.C. Court of Appeals Judge Sam J. Ervin, IV today made official his candidacy for the Supreme Court of North Carolina. He filed with the State Board of Elections to seek the seat currently held by Justice Paul Newby, one of seven seats on the state’s highest court.

Judge Ervin, a Morganton native, was elected to the N.C. Court of Appeals in 2008. He came to the Court from the North Carolina Utilities Commission where he served from 1999 through 2008.

“The law is the glue that holds society together. As a member of the Court of Appeals, I have applied it dispassionately, fairly, and conscientiously. I will do the same on the Supreme Court,” said Ervin.

Judge Ervin was admitted to the North Carolina Bar in 1981 and practiced law in his hometown of Morganton from 1981 until 1999. In private practice, Ervin handled a wide range of civil, criminal and administrative matters, including many appeals to the N.C. Court of Appeals and the Supreme Court of North Carolina.

Judge Ervin attended the Burke County public schools and graduated magna cum laude from Davidson College in 1978. Ervin received his law degree, cum laude, from Harvard Law School in 1981.

Ervin is a member of the First Presbyterian Church of Morganton, where he has served as a deacon and currently serves as an elder. He has been active in civic, charitable and bar-related activities and currently officiates youth, middle school and high school men’s and women’s soccer matches.

Judge Ervin is married to Mary Temple Ervin and has two step-children and two children. He resides in Morganton, in Burke County.

It’s just part of who he is.

He is the grandson of the legendary “Senator Sam,” Sam J. Ervin Jr. — but doesn’t mention that in the bio on his campaign website.

N.C. Court of Appeals Judge Sam J. Ervin, IV announced today that he will be a candidate for the Supreme Court of North Carolina in the 2012 election.

The Morganton native has created his campaign committee with the N.C. Board of Elections and will file for the Supreme Court seat during the February filing period. Judicial elections are conducted on a non-partisan basis.

“The law is the glue that holds our society together,” Judge Ervin said, in announcing his candidacy. “In order for the law to play its intended role, it must be applied dispassionately, fairly, and conscientiously. I have done my best to do this as a member of the Court of Appeals and will take this commitment to the Supreme Court.”

One of the seven seats on the Supreme Court will come before voters in 2012. Justice Paul Newby has announced his intention to seek re-election.

Judge Ervin was elected to the N.C. Court of Appeals in 2008. He came to the Court from the North Carolina Utilities Commission, on which he served from 1999 through 2009. The Commission is a quasi-judicial body that regulates investor-owned electric, natural gas, telephone, and water and sewer companies.
